A series of court decisions led to the so-called 'human rights loophole' which excluded residents of independent care homes from the protection of the Human Rights Act. Age Concern worked with a coalition of organisations to secure an amendment to the Health and Social Care Bill to close the loophole – at least for residents whose care is publicly arranged.
With the launch of its human rights inquiry‚ the Equality and Human Rights Commission is emerging as a human rights champion. Age Concern's evidence commented on the barriers hindering public bodies from making human rights more effective; lack of government leadership; and public authorities' failure to translate human rights policy into practice.
The United Nations' Principles for Older Persons are embedded into the national strategy for older people in Wales. These principles relate to independence‚ participation‚ care‚ self-fulfilment and dignity. We are arguing for the Principles to be incorporated into the national strategy in England.
