Arranging for others to make decisions about your finances or welfare - Factsheet 22

This factsheet is aimed at people aged 60 and over and deals with arrangements for others to make decisions about your finances‚ including arrangements you can make now in case you later lose capacity to make decisions yourself.

It also covers legal arrangements for others to make decisions about your healthcare and personal welfare when you no longer have capacity to do so. It also covers changes brought in by the Mental Capacity Act 2005 which is fully in force from October 2007.

It includes information about:

  • Decision making and mental capacity
  • Lasting Powers of Attorney and the old system of Enduring Powers of Attorney
  • Arrangements for others to access your finances‚ while you still have capacity to supervise them
  • The role of the Office of the Public Guardian and the Court of Protection
  • Deputies (and the old system of receivers)
  • Independent Mental Capacity Advocates
